Product Liability Doctrines

Who should pay for the effects of unsafe products, and how much should they pay? Who determines who is liable? What are the punitive and compensatory limits of product liability? First, it is important to note that there is “no uniform product liability statute or common law exists in the United States—each state defines product liability law under its own standards. However, product liability claims are generally brought under the scope of strict product, tort (negligence or fraud) and warranty,” as discussed in this section.71 A brief overview of some litigation over product liability cases may be helpful.

The ABA (American Bar Association) recently announced online that “The COVID-19 pandemic created an environment in which many companies are fighting unprecedented constraints to assist customers and keep their businesses alive. As they tackle new demands daily—on their businesses and capabilities to operate in the ‘new normal’—companies should not overlook how their actions will affect potential exposure to product liability claims related to COVID-19.”72
